Please read these terms and conditions carefully before using our services.

Agreement to Terms

By accessing or using Stone Ridge Development’s services, you agree to be bound by these Terms of Service and acknowledge that you have read, understood, and agree to all terms and conditions herein. If you do not agree to these terms, please do not use our services.

These terms apply to all visitors, users, and others who access or use our services, including our website, phone consultations, estimates, and on-site concrete, excavation, and construction services in Tennessee.

Services Offered

Stone Ridge Development (“Stone Ridge,” “we,” “us,” or “Contractor”) provides professional concrete, excavation, and construction services including, but not limited to:

  • Concrete flatwork (driveways, patios, walkways, slabs)
  • Structural concrete (footings, walls, foundations)
  • Concrete resurfacing, repair, and sealing
  • Excavation, grading, land clearing, trenching, and drainage solutions
  • Demolition and removal of existing concrete or small structures
  • Septic system excavation and installation support
  • Retaining walls, small building foundations, metal buildings, and related carpentry/construction work

All services are provided in the Tri-Cities / East Tennessee area, surrounding counties, and other regions within our normal service area as determined by the contractor.

Seasonal & Weather Limitations:

Concrete, excavation, and construction operations are subject to seasonal and weather limitations including:

  • Ambient temperature restrictions (generally minimum 40°F and rising for concrete placement, with suitable conditions 24 hours before and after installation)
  • Saturated or frozen ground conditions that prevent proper excavation, compaction, or finishing
  • Precipitation, storms, and severe weather

Work scheduled during marginal weather periods may be rescheduled or temporarily suspended at our discretion without penalty.

Estimates and Pricing

Free estimates are provided in good faith based on visual inspection and information available at the time of estimate. Final pricing may vary based on:

  • Actual site conditions discovered during excavation or demolition
  • Subsurface conditions
  • Changes to project scope
  • Material cost fluctuations
  • Permit requirements or inspection requirements
  • Utility conflicts or unforeseen conditions

Estimates are valid for 30 days from the date issued. Any changes to pricing exceeding 10% of the original estimate will be communicated and approved in writing before we proceed.

Subgrade & Site Conditions

Unless otherwise stated, estimates assume stable subgrade and typical site conditions. Additional charges may apply for:

  • Rock excavation or hammering
  • Unsuitable soil removal or over-excavation
  • Geotextile fabric installation
  • Additional base material or undercut
  • Dewatering operations
  • Soil stabilization or compaction beyond typical requirements

Customer is responsible for disclosing any known subsurface conditions including previous utilities, buried debris, underground structures, or soil contamination.

Calculator and Estimate Disclaimers

IMPORTANT: CALCULATOR AND ESTIMATE LIMITATIONS

All calculators, estimators, and pricing tools on our website, including but not limited to cost calculators, material calculators, and project estimators, provide ESTIMATES ONLY and are for informational purposes.

These tools:

  • Are approximations based on general assumptions and average conditions
  • Do not account for site-specific conditions, complications, or requirements
  • May not reflect current material costs or market conditions
  • Do not constitute a formal quote or contractual offer
  • Are subject to significant variation based on actual project requirements
  • Should not be relied upon for final budgeting without obtaining a formal written estimate

ACTUAL COSTS MAY VARY SIGNIFICANTLY from calculator estimates. For accurate pricing, you must obtain a formal written estimate after an on-site evaluation. Stone Ridge Development disclaims all liability for discrepancies between calculator estimates and actual costs.

Price Match Policy

PRICE MATCH TERMS AND CONDITIONS

While we strive to offer competitive pricing, any price match offers are subject to the following terms:

  • Competitor quotes must be in writing, dated within 30 days, and for an identical scope of work
  • Materials, specifications, warranty terms, and timeline must be substantially the same
  • Competitor must be a licensed and insured contractor in Tennessee
  • Price match excludes clearance, liquidation, “special deal,” or limited-time promotional pricing
  • Does not apply to partial quotes or unbundled services
  • Customer must provide complete competitor documentation for verification

WE RESERVE THE RIGHT TO REFUSE ANY PRICE MATCH REQUEST AT OUR SOLE DISCRETION.

Price match approval is not guaranteed and is subject to verification of all terms and conditions. We may decline to match prices that we determine to be below our cost, unsustainable, or not comparable in quality, scope, or warranty coverage.

Payment Terms

Payment terms will be clearly specified in your written estimate or contract.

  • For smaller residential projects (typically under $5,000), payment is generally required in full upon completion.
  • For larger or multi-phase projects, deposits and progress payments may be required as outlined in the contract.

We accept cash, check, and major credit cards. Financing options may be available for qualified customers.

Late payments are subject to a 1.5% monthly service charge (18% annual rate) and may result in lien filing. Customer is responsible for all collection costs and reasonable attorney fees if legal action becomes necessary.

Limited Warranty – Workmanship

IMPORTANT WARRANTY LIMITATION – READ CAREFULLY

Stone Ridge warrants its workmanship on concrete, excavation, and related construction services to be free from defects in installation for one (1) year from the completion date, limited to repair or replacement at our sole discretion.

This workmanship warranty applies to:

  • Proper installation and finishing of concrete work
  • Proper grading, compaction, and installation methods for site work
  • Proper construction techniques for retaining walls and small building structures

Work must have been performed in accordance with industry standards and the agreed scope.

THIS WARRANTY APPLIES ONLY TO WORKMANSHIP AND INSTALLATION – NOT TO MATERIALS.

Material Warranty Disclaimer

WE DO NOT WARRANTY MATERIALS SUPPLIED BY OTHERS

Stone Ridge provides NO SEPARATE WARRANTY on materials, including but not limited to:

  • Ready-mix concrete from any supplier
  • Aggregates, base stone, and backfill material
  • Concrete sealers, curing compounds, stains, or overlays
  • Masonry units, block, or retaining wall systems
  • Lumber, framing materials, siding, or trim
  • Metal building components, panels, or fasteners
  • Any materials provided by the customer or third parties
  • Any materials not manufactured by Stone Ridge Development

Any material warranties, if available, are provided directly by the manufacturer or supplier. The customer must pursue any material defect claims directly with those parties. Stone Ridge’s warranty covers only the labor and workmanship of installation, not the materials themselves.

Contractor disclaims all implied warranties, including merchantability and fitness for a particular purpose, regarding any materials used in construction.

Warranty Exclusions

Warranty specifically excludes, but is not limited to:

  • Normal wear, aging, weathering, color variation, or surface checking
  • Acts of God (freeze/thaw cycles, flooding, storms, earthquakes, etc.)
  • Settlement or movement of subgrade beyond contractor’s control, including clay or expansive soils
  • Cracking, scaling, or displacement caused by inadequate subgrade preparation when customer declined recommended improvements
  • Damage from vehicles or equipment exceeding design load capacity
  • Damage from de-icing salts, chemicals, oils, or petroleum products
  • Damage from snow plows, scraping blades, or chains
  • Root damage from trees or vegetation
  • Damage caused by utilities, other contractors, or third parties
  • Changes in drainage or site grading not caused by Stone Ridge
  • Hairline cracks and minor cosmetic issues that do not affect structural integrity (normal for concrete and masonry)

Maintenance Requirements

Warranty validity requires reasonable maintenance by the customer, including:

  • Avoiding heavy point loads on unsupported slab edges
  • Maintaining proper drainage away from concrete and structures
  • Sealing exterior concrete at reasonable intervals if recommended in writing
  • Promptly resealing cracks or joints that open beyond typical control joint widths
  • Avoiding harsh chemical exposure and promptly cleaning spills of petroleum products

Limitation of Liability

IMPORTANT LIABILITY LIMITATION

Stone Ridge’s total liability for any claim, whether in contract, tort, or otherwise, shall not exceed the total contract value paid by the customer. Stone Ridge shall not be liable for:

  • Indirect, incidental, consequential, or special damages
  • Lost profits or revenues
  • Business interruption
  • Punitive or exemplary damages under any circumstances.

Stone Ridge is not liable for:

  • Underground utilities not properly marked by Tennessee 811 or the appropriate utility locating service
  • Subsurface conditions including rock, water, contaminated soil, underground tanks, debris, or structures not disclosed
  • Weather-related delays or damage
  • Third-party claims except where caused by Stone Ridge’s proven negligence
  • Damage to landscaping, irrigation, fences, or other improvements not included in the agreed scope
  • Settlement or cracking due to inadequate subgrade preparation when the customer declined recommended improvements
  • Environmental contamination discovered during excavation
  • Delays due to permits, inspections, or regulatory compliance requirements

Material limitations: Stone Ridge disclaims liability for material defects, natural color variations, or supplier delivery delays. Concrete and other construction materials are manufactured to industry standards, but variations in color, finish, or appearance are normal and not grounds for warranty claims.

Site Conditions and Customer Responsibilities

Customer is responsible for:

  • Ensuring the contractor has safe and reasonable access to the work area, including adequate clearance for trucks and equipment
  • Removing or protecting personal property, vehicles, and landscaping within or adjacent to the work area
  • Calling Tennessee 811 utility location service at least 48 hours before work begins unless otherwise agreed in writing
  • Providing accurate property boundaries and known utility locations
  • Obtaining necessary permits unless specifically included in the contract
  • Ensuring pets and children are kept safely away from the work zone
  • Maintaining adequate drainage after project completion
  • Disclosing any known environmental contamination, underground storage tanks, or unstable soils
  • Providing adequate electrical power and water if required for the work

Compaction and Curing

Customer acknowledges that:

  • New concrete requires initial curing time and should be protected from traffic, heavy loads, and de-icing chemicals as recommended (typically 24–48 hours for foot traffic, longer for vehicles; up to 28 days for full design strength).
  • Edge support is critical; unsupported slab edges may crack and are not covered under warranty.
  • Proper drainage and maintenance are essential to prevent water infiltration and premature deterioration.

Change Orders and Additional Work

Any changes to the original scope of work must be approved in writing with pricing specified before additional work begins.

Additional work required due to unforeseen conditions will be charged at prevailing rates, which may include:

  • Equipment time
  • Materials at cost plus up to 20%
  • Labor rates as specified in the contract

Customer has the right to decline additional work; however, Stone Ridge may suspend work if conditions create safety concerns or prevent proper completion of the original scope.

Weather and Force Majeure

Concrete, excavation, and construction work require specific weather and site conditions. Work may be delayed or suspended due to:

  • Rain or storms
  • Extreme temperatures (below acceptable placement temperature or excessive heat)
  • High humidity, high winds, or saturated ground
  • Other adverse conditions affecting safety or quality

Stone Ridge is not liable for delays due to weather, acts of God, government actions, labor disputes, material shortages, or other circumstances beyond our reasonable control.

Governing Law and Dispute Resolution

These terms are governed by the laws of the State of Tennessee. Any disputes shall be resolved in the courts of Washington County, Tennessee.

Customer agrees to attempt good-faith mediation before filing suit. In any legal proceeding, the prevailing party is entitled to reasonable attorney fees and costs.

If any provision of these Terms is deemed unenforceable, the remaining provisions shall remain in full force and effect.

Insurance and Compliance

Stone Ridge Development maintains comprehensive general liability insurance and workers’ compensation coverage and complies with applicable local, state, and federal regulations. Surety bonding may be available for projects requiring bonded contractors, as agreed in writing.

This contract is subject to Tennessee contractor lien laws (Tennessee Code Annotated Title 66, Chapter 11). Stone Ridge has the right to file a mechanic’s lien for unpaid work.

For qualifying contracts, the customer may have a right to cancel within three (3) business days under the Tennessee Consumer Protection Act or other applicable law. Where required, cancellation notices will be provided as part of the written contract.

Utility Compliance

All work will be performed in compliance with Tennessee 811 utility location requirements. Customer acknowledges that utility locating is required by Tennessee law and that Stone Ridge is not responsible for unmarked or incorrectly marked utilities.

Modifications and Entire Agreement

These Terms may only be modified in a written document signed by both parties. These Terms, together with any written contract, proposal, or estimate issued by Stone Ridge, constitute the entire agreement between the parties and supersede all prior negotiations, representations, or agreements, whether written or oral.

No verbal promises or agreements not included in the written contract and these Terms are binding on Stone Ridge Development.
